The performance of discontinuous and limited in time, with the same amount of work with respect to benefits distributed with greater uniformity, can give rise to social security and health treatments completely different. The equality of treatment, however, may well meet the needs of the company, which he will obtain more flexible in relation to the points of need and allow the employee to reach more easily, the same result (Reels, Reels mini, or the new institution more egalitarian that will result from the powers in question, if the Jobs Act were to be finally approved).
The EU directive on the subject, adopted by Law 66/03, in fact, have a very conservative application, in that it is constantly being interpreted as having a time almost stationary and homogeneous in time.
The 40 or 38 hours a week, are in fact, “the norm”. In fact, the law in question puts limits on the contrary, since, giving an address to a normal time daily not more than 8 hours, determines that between one turn and the next day to elapse at least 11 hours of rest, and that there should weekly be at least 24 continuing to just rest.
It is reasonable therefore operate on a tape of availability of 13 hours for six working days.
If we combine this with the other ribbon regulatory constraint which requires that the average work performance on the quarter (expandable up to a year) should be at most 48 hours, we have a possibility of making a work performance which can be concentrated in the periods of maximum need. In addition, the relative outperformance can be offset by periods of low or no job performance.
The interest of the worker could see a considerable number of benefits resulting from the application of this mechanism.
But the greatest benefit to the employee, could be right in the retirement benefit. In particular, the accreditation of working days, for social security purposes, resulting from the sum of the daily hours worked in addition to the daily schedule contract shall be considered useful in the calculation of the minimum benefits required, such as for the maturation of the Mini Reels or dell’Aspi itself.
This may be worth, as in all systems, discontinuous where you need a minimum benefit in terms of working days per year.
A further positive effect may also result from the fact that the provision made in this manner as well as being more efficient for the company, will also lead to greater savings induced the improvement of the organizational structure, generating more cash that could go for the benefit of all parties, and company employees.
These could be even more increased by the determination of these mechanisms, combined with an economic and wage bargaining in the context of proximity (in its various forms), which would also have the merit to bring additional benefits in terms of cost contributions, social security and taxation, with the consequent reduction in the average “cost of business” of the work.
